INFORMATION ON THE PROCESSING OF PERSONAL DATA APPLICATIONS AND RECRUITMENT

Sampaolo Stampi s.r.l. wishes to inform you about the processing of your personal data.

This information is provided in accordance with the principles of transparency and fairness and in compliance with your rights, pursuant to current regulations on the protection of personal data

SOURCE AND NATURE OF DATA

Your personal data is collected:

  • directly from you, and were given to us following the spontaneous sending of your Curriculum Vitae.
  • by third parties (such as employment agencies, head hunting companies and recruiters) at our request, during personnel selection activities.
  • through online e-recruiting services, application and sharing of professional contacts (e.g. linkedin etc…), where you have made publicly available the professional information that concerns you.
  • through the e-recruiting portals that we have specifically activated and managed, where you have made available professional information about yourself.

In the case of your spontaneous sending of personal data, contained in the Curriculum Vitae or in other communications, we remind you that it is data freely given by you, with respect to which you pose as autonomous data controller, and of which it assumes all the obligations and responsibilities of law, conferring the widest possible respite with respect to any dispute, claim, request for compensation for damage caused by processing, etc. that we should receive from third parties whose information and personal data have been processed in violation of applicable regulations.

SPECIAL CATEGORIES OF PERSONAL DATA

In relation to the sending of the Curriculum Vitae or your participation in personnel selection and recruitment activities, the processing could involve data that can be qualified as “particular categories of personal data” (that is, data which reveal “racial or ethnic origin, political opinions, religious or philosophical convictions, or trade union membership, genetic data, biometric data intended to uniquely identify a natural person, data relating to the health or sexual life or sexual orientation of the person”) or

Your consent is required for the processing of these particular categories of data, which you may include in the Curriculum Vitae or other communications. Therefore Sampaolo Stampi s.r.l. reserves the right to accept documents or communications containing such data that are not authorized for processing.

If in the context of our recruitment processes there is a specific need to acquire and process data of a particular type or also relating to criminal convictions and offences, we will inform you about it, integrating this information and proceeding to the acquisition of consent, if it is a condition for the initiation or continuation of the processing itself.

PURPOSE OF THE PROCESSING

The processing is carried out in order to evaluate your professionalism, as part of our personnel selection activities, for possible inclusion within our staff.

For the processing of sensitive data contained in the CV or other documentation, the legal basis is your consent (Article 6 para 1 lett a) of the GDPR).

The legal basis for the processing of identifying data is the fulfilment, before the conclusion of the contract, to your specific requests (art. 1 lett. b) of the GDPR), which constitute the legal basis for processing.

METHODS OF PROCESSING

The processing is carried out by means of procedures and tools, including information technology, suitable to guarantee confidentiality, the integrity and availability of data in the ways and to the extent necessary to pursue the above-mentioned purposes and in compliance with the technical and organizational security measures adopted by our organization.

Your personal data is processed exclusively by authorized and trained personnel, to which access to your personal data is granted to the extent and to the extent that it is necessary for carrying out the activities of evaluating applications and selecting personnel.

Data that is surplus or not relevant to the purposes of processing will be deleted or not used, if necessary using techniques of pseudonymization or separation of particular data (e.g. complete content of your CV) from identifying data  (e.g. contact information and job description summaries, job descriptions, job applications).

USE OF AUTOMATED DECISION-MAKING OR MONITORING

Sampaolo Stampi s.r.l. will not use automated decision-making or monitoring systems, including profiling, designed to provide information relevant to the personnel selection process, the evaluation of candidates, the taking-over or conferring of the post.

Non-evaluation computer systems may be used to manage the initial phase of the selection process, including for example computerized multiple-choice questionnaires. The selection process will always involve supervision and intervention by an operator.

Where Sampaolo Stampi s.r.l. should, in the future, make use of it, it will comply with the additional information obligations provided for by law.

DURATION OF PROCESSING

Respecting the principles of lawfulness, limitation of purposes and minimization of data, the retention period of your personal data is established for a period not exceeding the achievement of the purposes of personnel selection and evaluation and in compliance with the time prescribed by law.

In particular, your Curriculum Vitae, unless you indicate otherwise, may be kept for a period of no more than 6 months. In addition, in order to be able to contact you again on the occasion of possible availability of working positions, your identification and contact data (name, surname, professional scope, telephone and e-mail) may be kept for a further period of no more than 12 months, respecting your right, among others, to request at any time the presence and deletion of your data from our archives.

In any case, Sampaolo Stampi s.r.l., to protect its own interests, for example in the event of a dispute, will keep your personal data until the time allowed by law.

OBLIGATION OR OPTION TO PROVIDE DATA

The provision of data is optional and their failure to indicate it means that it is impossible to proceed with the process of evaluating and selecting staff for a possible inclusion of our staff.

RECIPIENTS OF DATA

KNOWLEDGE AREA WITHIN THE ORGANIZATION

The following categories of subjects within our organization may become aware of your data: internal administrative and secretarial offices, management and personnel selection officers. All subjects who access your data are appropriately authorized, instructed and bound to confidentiality obligations.

To ensure the confidentiality of your data, we invite you to contact our offices before sending documents and communications in order to receive confirmation of the correct contact details.

EXTERNAL COMMUNICATION OF DATA

Your data will not be disclosed (for example by publication on the web), unless we expressly request it and you give your explicit consent.

Your data may be communicated to:

  • public or private entities that may access it under the law, regulations or Community legislation, within the limits provided by these rules
  • to subjects our consultants, in the limits necessary to carry out their duties with our organization, subject to appointment that imposes confidentiality and security obligations
  • to subjects who process data for purposes auxiliary to the relationship with us, or who perform or provide specific services strictly functional to the execution of that relationship (for example, pouch, printing and shipping services, electronic communications service providers or web services)
  • to companies, entities or associations, parent companies, subsidiaries, associates or jointly controlled companies, as well as between consortia, networks of undertakings and groups and temporary associations of undertakings and their members

The communication of your personal data is limited to the data necessary for the achievement of the specific purposes for which they are intended.

TRANSFER OF PERSONAL DATA OUTSIDE THE EU

Your personal data will not be transferred to third parties outside the European Union.

If this occurs, for example due to the use of application management services (such as the use of external application management platforms), we will warn you with appropriate information.

YOUR RIGHTS

At any time you may exercise the rights that are granted to you, pursuant to art. 15 to 22 of EU Regulation 2016/679, namely:

  1. request confirmation of the existence or otherwise of personal data processed;
  2. obtain information about the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom the personal data have been or will be communicated, the retention period for the data or the criteria used to determine it;
  3. update or correct personal data so that it is always accurate;
  4. delete personal data when they are no longer necessary for the purposes of processing, if the legal conditions exist and the processing is not justified by another legitimate reason;
  5. Restrict the processing of personal data, where the conditions are met, including inaccuracy, opposition to processing, unlawful processing.
  6. obtain the portability of data, if the processing takes place on the basis of a contract and with automated means, that is to receive them in a structured format, commonly used and readable by automatic device, also for the purpose of transmitting them to another controller;
  7. oppose the processing at any time and also in the case of processing for direct marketing purposes or carried out through automated decision-making processes, including profiling.
  8. revoke consent, if given for specific processing activities. The revocation of consent does not affect the lawfulness of the processing based on the consent carried out before the revocation;
  9. the right to lodge a complaint with a Supervisory Authority: without prejudice to any other administrative or judicial action, the complaint may be submitted to the Supervisory Authority for the protection of personal data. Or, if the conditions are met, including your different residence or the different Member State in which the infringement occurred, to the supervisory authorities established in another EU country.

If Sampaolo Stampi s.r.l. intends to start processing data for purposes other than those described in this information, it will inform you before proceeding and obtain your consent, if necessary.

UPDATES

Sampaolo Stampi s.r.l. updates the policies and internal practices adopted in the protection of personal data whenever necessary and in case of regulatory and organizational changes that have relevance to the processing of personal data.

Any updates to this information will be made available promptly and by appropriate means.
