INFORMATION ON THE PROCESSING OF DATA BY VIDEO SURVEILLANCE

Information pursuant to art. 3.1 Measure of the Data Protection Authority of 8 April 2010; andof art. 13 of Regulation EU 2016/679

We inform you that the processing of your personal data by means of video surveillance systems is carried out according to the principles of correctness, lawfulness and transparency, in order to protect your confidentiality and your rights, in accordance with the procedures specified below.

DATA CONTROLLER

NATURE OF THE DATA PROCESSED

The processing concerns data acquired by video surveillance systems

PURPOSE AND LEGAL BASIS OF PROCESSING

The personal data of the data subjects, and in particular the image recordings, are collected for the following purposes:

  • protection of the company assets against possible theft, damage, vandalism or other unlawful acts that may occur in the areas subject to video surveillance, both during the day and at night
  • supplementary measure to improve the safety of buildings and installations where production activities are carried out or which have the purpose, as means of proof, of facilitating their possible use in civil or criminal proceedings, the right of defence of the controller or third parties on the basis of images useful in the event of unlawful acts
  • Protection of the safety of individuals and security of users

The processing of data is carried out on the basis of the legitimate interest of the Data Controller (art. 6 par. 1 letter f) of the GDPR and art. 6.2.2. of the Measure 8 April 2010)

METHODS OF PROCESSING

The video surveillance system is equipped with external cameras and allows both recording and viewing of images in real time.

The video surveillance system is in operation 24 hours a day, 7 days a week.

The display of images taken through the video surveillance system is carried out only by the data controller or persons specially appointed by them in writing;

The processing of data takes place through the use of procedures and tools, including information technology, suitable to guarantee security and confidentiality in the ways and within the limits necessary to pursue these purposes and in accordance with the following principles:

  • Lawfulness: the processing of data is carried out in accordance with the principle of balance of interests, for the legitimate purposes described above. The facilities are used in compliance with Article 4 of the Workers’ Statute (Law 300/70).
  • Necessity: excessive and redundant data processing, camera positioning, image recording are avoided
  • Proportionality: the data collected is strictly necessary to achieve the purposes specified above

STORAGE TIMES FOR IMAGES

The detected images are recorded and stored for a period of 48 hours, except for public holidays and company closures in general, with subsequent automatic deletion.

The storage may be extended in case of storage requirements as evidence to facilitate the possible exercise of the right of defence of the Controller or third parties in the event of unlawful acts, and in the event that you have to comply with a specific investigative request and the Judicial Authority or Police.

In this case, the processing will continue for the duration of the dispute and/or proceedings.

PROVISION OF DATA

The provision of data through video surveillance is necessary, as instrumental to access premises and areas. The refusal to provide such data, access to video-monitored areas, may result in the impossibility of accessing the facility.

INFORMATION ON PROCESSING

The subjects concerned by the treatment, subject to the video surveillance recordings, are appropriately notified of the treatment by affixing synthetic information (signs) affixed in the vicinity of the video surveillance areas, before the cone of recording.

SCOPE OF DATA KNOWLEDGE

They can become aware of the internal and external data subjects authorized to operate and maintain the video surveillance system. These entities are classified as Data Processors or Persons in charge of processing, they are designated in writing and are authorized to access the premises where the installations and control stations are located, to use the installations themselves and, in cases where it is essential for the purposes pursued, to view the images and/ or make a copy.

COMMUNICATION AND DISSEMINATION

The data may only be communicated to subjects who can access the data under the law, regulation or Community legislation, within the limits provided by those rules, such as police forces, judicial authorities or police, Subject to specific request and authorization.

RIGHTS OF DATA SUBJECTS

At any time you may exercise, pursuant to artt. 15-22 of Regulation EU 2016/679 and regarding the processing of data derived from video surveillance systems, the right to:

  • ask for confirmation of the existence or not of their personal data;
  • obtain information about the purposes of processing, categories of personal data, recipients or categories of recipients to whom personal data has been or will be communicated and, where possible, the retention period;
  • obtain the rectification and deletion of data when it is no longer necessary for the purposes of processing, if the legal conditions are met and the processing is not justified by another legitimate reason;
  • obtain the restriction of processing, if the conditions are met, including inaccuracy, opposition to processing, unlawful processing of data.
  • submit a complaint to a Supervisory Authority: without prejudice to any other administrative or judicial action, the complaint may be submitted to the Supervisory Authority for the protection of personal data (in Italy www.garanteprivacy.it, phone number 06.696771, email urp@gpdp.it).
